摘要

“适度放活”宅基地和农民房屋使用权是宅基地“三权分置”改革的重要措施。但由于试点改革关于宅基地“三权”的权利性质、边界等未能达成共识，影响了改革政策的立法转化。学界讨论主要着眼于扩权赋能的宅基地权利配置及其体系建构，而忽略了“适度放活”内涵于“三权分置”中的价值目标和制度功能，影响了宅基地使用权的流转权能的实践性赋予。在我国现行法律和理论框架下对“适度放活”进行立法转化，应以宅基地“三权”的确权赋能、宅基地利用的违法纠正为基础和保障，遵循既有的土地用途管制红线，最终实现“适度放活”制度贯彻的体系化和法治化。

Abstract

"Moderate release" homestead and farmer's house use right are important measures for the reform of "separation of three rights" of homestead. However， due to the lack of consensus on the nature and boundary of the three rights of homestead in the pilot reform， the legislative transformation of the reform policy has been affected. The current academic discussion mainly focuses on the allocation of homestead rights and its system construction， but ignores the value goal and system function of the connotation of "moderate release" in the "separation of three rights"， which affects the practical empowerment of the homestead usufruct. Under the current legal and theoretical framework of our country， the legislative transformation of "moderate release" should be based on the confirmation and empowerment of the "three rights" of homestead and the correction of the illegal use of homestead， never touch the bottom line in land use management， and finally realize the systematization and legalization of the implementation of "moderate release" system.
