摘要

地域性是地理标志最核心的特征，表现为地理标志命名的地缘性、使用主体的区域性、产品特性的地域关联性。该特性使得地理标志保护面临重叠保护，“公地悲剧”以及侵权救济难等困局。可确立在先权利优先原则和共存规则解决重叠保护问题；严格权利主体标准和规范使用行为预防“公地悲剧”的发生；扩大诉讼主体范围和明确正当使用的条件化解侵权救济的难题等。《民法典》已明确将地理标志列为知识产权的客体之一，为发挥地理标志促进农业发展、农民增收、农村繁荣的功能，我国应尽早制定《地理标志保护法》。

Abstract

Regionality is the core feature of geographical indications， which are manifested as the geographical naming of geographical indications， the regional use of the subject， and the regional relevance of product characteristics. This feature makes the geographical indications protection face such difficulties as overlapping protection， "ragedy of the commons"， and difficult infringement relief. Establishing the priority principle of prior rights and the co-existence rule can solve the problem of overlapping protection. Standardizing rights subject and use behavior can prevent the occurrence of tragedy of the commons. Expanding the scope of the itigation subject and clarifing the conditions of legitimate use can resolve the difficulty of infringement relief. The Civil Code has clearly listed geographical indications as one of the objects of intellectual property rights. In order to play the role of geographical indications to promote agricultural development， increase farmers' income and rural prosperity， we should formulate the Law of Geographical indications Protection as soon as possible in China.
