摘要

在农村集体产权制度改革和第二轮土地延包试点推进的背景下，如何做到群众认可、规范清晰地界定集体经济组织成员资格是现阶段我国农村最为紧迫的问题。为理清目前农村集体经济组织成员资格认定的现状，从学术文献、地方和司法实践方面对成员资格认定问题进行了归纳综述；总结了学界和政策中逐步规范使用“农村集体经济组织成员”这一概念，但成员资格认定的具体标准未统一，实践途径中的集体决议、地方立法、司法指导和司法裁判也面临做法不一的事实困境；最后指出了未来学术研究的主流和方向，未来国家层面的立法中也应是仅给出核心要素或基本标准，具体标准则因地制宜，为地方实践预留空间。

Abstract

Under the background of the reform of rural collective property rights system and the promotion of the second round of land contract extension pilot project， how to achieve mass recognition and clearly define the membership of collective economic organizations is the most urgent issue in rural China at this stage. In order to clarify the status quo of membership accreditation of rural collective economic organizations， this paper summarizes the problems of membership accreditation from the aspects of academic literature， local and judicial practice. It is summarized that the concept of "members of rural collective economic organizations" has been gradually standardized in academic circles and policies， but the specific standards for the identification of membership have not been unified， and the realistic difficulties is that collective resolutions， local legislation， judicial guidance and judicial adjudication have different practices. Finally， it points out the mainstream and direction of future academic research， and stresses that the future legislation at the national level should merely focuses on the core elements or basic standards while specific standards should be left to the local government to decide according to the local condition， leaving enough space for local practice.
