摘要

直播带货对西部农产品拓展销售市场、有效激活与转化消费潜力具有积极的意义，是巩固脱贫攻坚成果，全面推进乡村振兴战略的重要举措。这种新型电商营销模式起步较晚、发展迅猛，在引领直播带货新风口的同时，客观上诱发产品质量安全、知识产权侵权、虚假宣传等法律风险，有触碰法律红线、透支粉丝信任之虞。在电商直播强监管时代，西部地区农产品电商直播营销迎来大考，破解路径在于加强各方营销主体的合规建设，尤其是强化履行农产品质量审核义务、加强直播宣传行为合规管理义务、农产品供应商信息的检验与留存义务。司法行政机构应贯彻落实“谁执法谁普法”机制；消费者作为直播带货的最后环节，应具备基本的维权理论与技能，敢于维权、善于维权、合法维权。

Abstract

The E-commerce live streaming is of great importance to agricultural development in western China by expanding sales of agricultural products， activating and transforming consumption potential effectively， which is one of the most essential measures taken to consolidate the victory in the fight against poverty and to pursue the rural vitalization strategy. Although the E-commerce live streaming started late， it is on the rise.However， it is very likely to touch the legal red line and overdraft consumer trust because it tends to induce such legal risks like product quality and safety， intellectual property infringement， false advertising and so on. In the era of strict supervision， they should strengthen the compliance construction of marketing entities， especially in implementing quality audit obligations， strengthening compliance management of advertising and in carrying out duty of verifying and retaining the information of the suppliers. The law enforcement departments are responsible for strengthening public legal awareness. Customers should be equipped with the basic theory and technique in order to protect their legal rights and interests.
