Abstract

According to the theory of economics and law，the market-oriented reform of homestead for the purpose of promoting the optimal allocation of land resources，realizing the property value of the right to use homestead and guaranteeing the exercise of farmers' property rights is an important way to promote the common prosperity of urban and rural areas. By using the classical analytical logic of economics —— C-M framework，it is found that in the market-oriented reform of homestead，while the application of "prohibition rules" is too conservative， the application of "property rules" and "responsibility rules" is slightly weak due to the existence of high transaction costs and the limitations of value evaluation methods and capabilities. The application of "control rules" not only conforms to the characteristics of the homestead itself，but also reduce transaction costs and ensure the implementation of rules. Under the "control rules"，it is necessary to build an institutional framework with property right confirmation as the premise，homestead trading market platform construction as the focus，central and local cooperative supervision as the key，and finally form a penetrating risk prevention and control system with rights confirmation in the early stage，market supervision in the middle stage，and punishment in the late stage.
