摘要

日本《地理标志法》自2015年正式施行，标志着日本地理标志保护进入专门法与商标法混合保护的时代。该法结构合理，确立了生产者利益、产业发展、消费者利益三重保护目的，明确了保护对象的范围。该法主要就地理标志的注册、管理以及不法利用地理标志的法律责任进行了规范，并在兼顾公益和私益、信息充分公开与交流、平衡与商标法的关系等方面有创新。我国《民法典》已将地理标志单列为知识产权的客体之一，实施该法典，应借鉴日本的经验，整合我国现有地理标志保护制度，制定我国的《地理标志法》。

Abstract

The Law of Geographical Indications in Japan was formally implemented in 2015 ， marking the new era of the mixed protection of the specialized law and the trademark law. Built with a reasonable structure， the law defines its triple protection purpose for the producer's interest， industrial development， and consumer interest and clarifies the scope of protection. The law mainly standardizes the registration and management as well as the legal liability for illegal use of geographical indications. Moreover， the law innovated in balancing the public interests and private interests， information disclosure and exchange， and its relationship with the trademark law. In China， the geographical indications have been listed as one object of intellectual property right in Civil Code. To implement the Code， learning from Japan's experience and integrating China's existing protection system of geographical indications is a must in formulating the Law of Geographical Indications in China.
